Over the last decade, there have been many federal changes to income, gift, estate and generation-skipping transfer tax statutes. In 2013, for the first time, Congress implemented the concept of estate portability between spouses, which can provide a significant tax savings upon the death of the first spouse. Although the federal estate tax exemption is higher than ever before, Oregon’s estate tax remains at $1 million. Considering the value of home ownership coupled with either a retirement asset or life insurance value, many clients need an estate plan to account for the Oregon estate tax.

It is often a confusing time when loved ones pass away. We explain the legal process clearly and respectfully, and help clients determine whether a small estate affidavit or a full probate is appropriate. Probate matters often involve real estate in multiple jurisdictions and various assets from the straightforward to the unique.

Partner Lori Murphy is also experienced and highly regarded in the administration of estates related to personal injury, wrongful-death, class action lawsuits, wherein a resident of Oregon or Virginia has died during the course of the lawsuit. Such sensitive cases often include those where a conservator, guardian, or guardian of a minor’s estate need to be appointed. Lori has personally served in all of these capacities and understands the challenges associated with these roles.
